CONFIDENTIALITY OF ALCOHOL AND DRUG ABUSE CLIENT RECORDS
The confidentiality of alcohol and drug abuse client records are protected by federal law and regulations (per 42 CFR, Chapter 1, Part 2). Specifically, treatment programs may not disclose to a those outside the designatd program that a client attends the program, or share any information identifying clients with an alcohol or drug abuse condition unless:
- A written request allowing the disclosure is provided by the client; or
- A court order allows for disclosure; or
- Disclosure is made to medical personnel in a medical emergency or to designated and qualified staff for research, audit, or program evaluation.
